Terms and Conditions
Patternfly and PatternflyCollection are brand names owned by Ahola Production Design. All content of Patternfly or PatternflyCollection are released under Ahola Production Design. These General Terms and Conditions covern all offers, content, performance and agreements concluded between Ahola Production Design and the Client. For the particular design disciplines or/and services, other specific terms and conditions may apply.
General Terms and Conditions (February 2019)
Article 1. Definitions
We
The designer; Ahola Production Design, located at Wenneker 16 in Eibergen in the Netherlands and listed with the Chamber of Commerce under registration number 32125014. Also member of BNO, de Beroepsorganisatie Nederlandse Ontwerpers.
You
The client; the natural or legal persons that has concluded an Agreement with us or to whom we have submitted a quotation in that connection.
General Terms and Conditions
This document consists of 2 parts; the general terms and conditions of BNO – de Beroepsorganisatie Nederlandse Ontwerpers filed with the Chamber of Commerce in February 2013 under registration number 40539096 and the additional conditions in derogation of or in addition to BNO’s General Conditions (2013).
Service
The specific service agreed on between the Designer and the Client, as stated in the Agreement or the quotation.
Agreement
The agreement between the designer and the client, under which the designer will perform the Service.

Article 2. The general terms and conditions of BNO
These General Terms and Conditions are a translation of the ‘Algemene Voorwaarden van de Beroepsorganisatie Nederlandse Ontwerpers BNO”, filed with the Chamber of Commerce for Amsterdam under number 40539096. In the event any difference between two Terms and Conditions, the Dutch text will prevail. Available for download here below.
Article 3. The additional conditions of Ahola Production Design
The following provisions apply in derogation of or in addition to BNO’s General Conditions (2013) as stated in the Agreement or the quotation.
Intellectual property and ownership rights
Unless otherwise agreed all rights of intellectual property rights rising from the work commissioned -including drawing- and design rights and copyrights – in respect of the results of the work commissioned are vested in Ahola Production Design, irrespective or whether they have been available to the client or to third parties.
Notice of termination and dissolution of the agreement
If, the agreement is terminated before the performance has been completed without any breach on the part of Ahola Production Design, the client is liable for damages in addition to the fee and the costs incurred in connection with the work performed until that time. If the client gives notice of termination of the agreement, the client is not entitled to use the (original) design or any part of the work performed by Ahola Production Design.
Limitation of Liability
Ahola Production Design is only liable towards the client for the design. Ahola Production Design’s liability for the indirect damage, including materials, manufacturing failures is excluded. In no event shall Ahola Production Design be liable towards the client for indirect damage including consequental damages, nor for any infringements of intellectual property, copyright or trademark rights to third parties. The client indemnifies Ahola Production Design against claims from third parties.
In all circumstances the liability for the direct damage caused by the failure which occur in the performance of the work is limited to the fee that Ahola Production Design charged for the work commissioned, or in any event the part of the work commissioned to which the liability relates.
Article 4. Changes to General Terms and Conditions
We reserve the right to amend or supplement these Terms and Conditions. Changes also apply to Agreements that they have already been concluded, with due observance of a period of 30 days after publication of the change on our Website or by electronic notification. Changes of minor importance can be made at any time.
